1. Scope

These Terms of Use apply to the use of the mobile application "getNudge" (hereinafter "App") and the associated website, operated by Digital Solutions by Timo Grosche, Thomas-Müntzer-Straße 5, 01744 Dippoldiswalde, Germany (hereinafter "Operator").

By registering for and using the App, you agree to these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Services

getNudge is a health and wellness app that provides the following features:

• Recording and analysis of nutritional data (meals, macronutrients, water, supplements)
• Integration of health data from Apple Health and Google Health Connect
• Personalized health nudges based on your data
• N=1 experiments to identify individual correlations
• Visualization of trends and recovery data
• Read-only access to selected data via the public getNudge app in ChatGPT

3. Registration and User Account

Registration is required to use the App. You may register via email or sign in with Google or Apple.

You are required to provide truthful information during registration and to keep your login credentials confidential. You are responsible for all activities that occur under your account.

If you notice any unauthorized access to your account, please inform us immediately at hello@get-nudge.de.

4. User Obligations

You agree to use the App only in accordance with applicable laws and these Terms of Use. In particular, the following is prohibited:

• Using the App for unlawful purposes
• Sharing login credentials with third parties or sharing accounts
• Technically manipulating or decompiling the App
• Performing automated access to the App (bots, scraping)
• Posting content that violates applicable law

5. Health Disclaimer

The information, nudges, and analyses provided in the App are intended solely for general health orientation and personal well-being. They do not constitute medical advice.

In particular:

• getNudge does not provide medical diagnoses and does not give therapeutic recommendations
• AI-powered nudges and analyses are not medical recommendations
• Health-related decisions should always be made in consultation with qualified medical professionals
• If you experience health issues, please consult a physician

The Operator assumes no liability for health-related decisions made on the basis of information displayed in the App.

5.1 ChatGPT Connector

The public getNudge app in ChatGPT allows read-only access in v1 to selected data areas of your getNudge account. A connection is only established when you actively authorize it on our consent page.

The Connector is not a separate account service but accesses data within the scope of your existing getNudge login. Write operations, unrestricted database queries, and medical use are excluded.

6. Intellectual Property

All content of the App, including text, graphics, logos, software, and design, is protected by copyright and is the property of the Operator or its licensors.

Use of the App grants you a personal, non-transferable, non-exclusive right to use the App within the scope of these terms. Any reproduction, distribution, or exploitation beyond this is not permitted without written consent.

7. Limitation of Liability

The Operator is fully liable for intent and gross negligence. For slight negligence, the Operator is only liable in case of breach of essential contractual obligations (cardinal obligations), whereby liability is limited to the foreseeable, contract-typical damage.

The Operator does not guarantee uninterrupted availability of the App. Maintenance work, technical disruptions, or force majeure may lead to temporary restrictions.

Liability for damages arising from injury to life, body, or health remains unaffected.

8. Data Protection

The protection of your personal data is important to us. For details on the collection, processing, and use of your data, please refer to our Privacy Policy.

9. Changes to the Terms of Use

The Operator reserves the right to amend these Terms of Use at any time. You will be informed of material changes in a timely manner. Continued use of the App after the changes take effect constitutes acceptance of the amended terms.

The current version of the Terms of Use is always available at get-nudge.de/nutzungsbedingungen.

10. Termination and Account Deletion

You may delete your account at any time via the App settings. Upon deletion, all your personal data will be irreversibly removed.

The Operator may suspend or delete your account in the event of serious violations of these Terms of Use. In such cases, you will be notified by email.

11. Applicable Law and Jurisdiction

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory consumer protection provisions of the state in which the consumer has their habitual residence shall additionally apply.

The place of jurisdiction, to the extent permitted by law, shall be the registered office of the Operator.

12. Final Provisions

Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
